City of Rockingham Competition Terms and Conditions

  1. Promoter Details

Destination Perth's City of Rockingham social media promotion (“Promotion”) is conducted by Destination Perth (ABN 52 954 492 460) (“Promoter”), based in Western Australia.

The Promotion includes prizes provided by various suppliers including:

Tourism Rockingham, Rockingham Visitor Centre, Capricorn Sea-kayaking and Naragebup/Rockingham Regional Environment Centre

  1. Promotion Period

The Promotion period commences at 9:00AM AWST on Wednesday 26th March 2025 and ends at 9:00AM on Wednesday 9th April 2025. (“Promotional Period”). 

After the end date, no further entries will be permitted.

  1. Promotion Terms and acceptance

Information on how to enter and the prizes may be advertised by the Promoter and Suppliers on their individual website and social media accounts.

Additional information or instructions published by the Promoter relating to or about the Promotion, will form part of these Terms and Conditions (“Terms”).

By submitting an entry, the “Entrant” is deemed to have accepted these Terms.

Entrant Eligibility

Related Entity means: Employees (and their Immediate Family and/or those living in the same household), affiliates, subsidiaries, agencies and suppliers associated with this promotion are ineligible to enter.

Immediate Family means: any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

  1. Costs

There are no costs to enter the Promotion.

  1. How to Enter

To enter, during the Promotional Period, Entrants must:

  3. tag a friend on the Promoter’s specific Facebook post here: https://www.facebook.com/share/p/1GjhnYcgrC/

During the Promotional Period, Entrants may submit multiple entries, as long as they tag a new friend/account each time.

  1. Incomplete or non-compliant entries

The Promoter reserves the right to treat any entries which are found to be invalid, incomplete, fraudulent, indecipherable or inappropriate, to be void entries. Errors and omissions may be accepted at the Promoter's discretion.

The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.

  1. Platform 

The Entrant explicitly acknowledges and understands that this Promotion is in no way sponsored, endorsed or administered by, or otherwise associated with Instagram and they are not a party to, nor liable to any Entrant for any claims in connection with the Promotion or any of the Prizes offered.

  1. Determination of Winner

This Promotion is defined as a Trade Promotion Lottery. All eligible entries will be assigned a number and the total number of entries will be added as the ‘maximum’ number in the online random number generator.

At the end of the Promotional Period, at 9:00AM on Wednesday 9th April 2025 at the Perth office of the Promoter, 418 Murray Street, Perth, Western Australia, 6000 the online random number generator will be used and a single number generated. The associated entry with that number will be the winner of the Prize.  

The determination of the winner is final (subject to the unclaimed Prizes and Redraw provision) and the Promoter will not enter into communications regarding the administration, Terms or results of the prize draw.

  1. Notification of Winner and Claiming of Prize

The Promotor will notify the winner via Facebook direct message on Wednesday 9th April 2025 and request further information from the entrant to verify their identity.

The winner agrees that, to claim the Prize they must:

  1. acknowledge the direct message on Facebook; and
  2. send an email to briana@destinationperth.com.au with the verification information requested the Promoter.  

The Prize must be claimed by the winner no later than 48 Hours from the date of notice being provided.

If a winner of the Prize is under the age of 18 years and is not based in Western Australia the Prize will automatically be forfeited by that Entrant, and a redraw will occur.

  1. Unclaimed Prizes and Redraws  

If for any reason a winner does not acknowledge, accept and claim their Prize or fails to provide the verification information to the Promoter within the timeframe listed above, they will deemed to have forfeited the Prize, and another winner will be drawn by the same mechanism as described above at Item 8, within 2 Business Days.

The Promoter will have no liability for a winner's failure to receive notices due to winner’s spam, junk email or other security settings or for a winner’s provision of incorrect or otherwise non-functioning contact information.

  1. The Prize

The winner of the Prize will receive 2 nights' accommodation at Bayside Beach Retreat in a 2-bedroom property, entry at Naragebup Environmental Centre (2 adults, 3 children), family welcome pack including soft toy (dolphin/penguin) x3, twin pack St John wine & chocolates, and Capricorn Seakayaking Oyster Catcher Rockingham Family Kayaking Adventure (2 adults, 3 children).

Total Prize valued at up to $1284.50 AUD. Stays valid until end of October 2025.

  1. Prize redemption and conditions

Prize collection/redemption to be via the Rockingham Visitor Centre.

All Prize redemptions are also subject to any terms and conditions imposed by the Supplier of the Prize, including terms of entry to any venue.

Prizes cannot be exchanged for alternative prizes, goods or cash, nor can they be sold or otherwise transferred to any person, with the exception of changes for accessibility reasons.

The winner is solely responsible for any and all travel expenses that are not expressly included in the Prize including but not limited to travel to and from the nominated departure point, meals, beverages or tips.

The Winner may be required to present their own credit card at the time of check-in as a security measures for charges incurred which are not included in the Prize. The winner agrees to do so at their own risk.  

Where the Prize includes a multi-party experience, the winner is solely responsible for determining who to share the Prize with. 

Where the Prize includes food and beverage experiences, the Promoter encourages the safe, legal and responsible consumption of alcohol and winners  are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines and at DrinkWise.

If a winner has any accessibility limitations which they believe will impact on their ability to enjoy the Prize, they are required to notify the Promoter at the time of acceptance of the Prize as to the nature of the limitation and the Promoter will use their best endeavours to offer an alternative prize to equal value of the original.

  1. Force majeure

In the event of war, terrorism, pandemic or epidemic, state of emergency, government restrictions or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion, or suspend or modify a Prize at anytime during the Promotional Period.

The Promoter will publish any changes regarding the Promotion as soon as reasonably practical.

  1. Intellectual Property

As a condition of entering the Promotion, each Entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

  1. Marketing and Promotion

It is a condition of entry that Entrants agree to have their email address added to the Promoter’s email list for the duration of the Promotional Period. The Promoter is expressly authorised to share the Entrants email address with the Suppliers, who may also add the Entrant to their email list for the duration of the Promotional Period. The Entrant will be entitled to unsubscribe from the Promoter or Supplier’s mailing lists in the future in accordance with the Spam Act 2003 (Cth).

The winner(s) agree to participate in all promotional activity (such as publicity and photography) in connection with the Promotion and/ or the winning of the Prize (as reasonably requested by the Promoter.

By accepting the Prize, the winner consents to the Promoter and Suppliers using their names, likeness, images and/or voices (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promoter.

  1. Personal Information

Entrants understand and agree that by entering the Promotion, the Promoter will be required to collect and deal with the Entrants personal information, which they will do in accordance with the Promoter’s Privacy Policy.  

The Entrant also consents to the disclosure of such information to third parties, including but not limited to Suppliers, agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities for the purpose of running the Promotion.  

The Promoter may, for an indefinite period, unless otherwise advised, use this information, and disclose this information to third parties, including for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant.

Entrants should direct any request to opt out, access, update or correct personal information to the Promoter.

  1. Compliance and Record Keeping

A copy of these Terms have been provided to the Gaming and Wagering Commission of Western Australia. 

Records relating to this Promotion will be kept for a minimum of 12 months and must be made available to an authorised officer on request. Audit records confirming the prize draw will be made available to an authorised officer on request.

  1. Limitation of Liability

Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, (“Non-Excludable Guarantees”).

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all claims, liability, loss or damage (including loss of opportunity) suffered or incurred by any person, whether direct, indirect, special or consequential, arising in any way out of or connected to the Promotion or these Terms.

The Promoter accepts no liability for any problems or technical malfunction of computer systems, servers, software, internet service provider or email systems, including failure of any entry to be received on account of technical problems, or the failure of a winner to receive a notification due to such technical problems.

The Winner may be required to sign further legal releases and or indemnities provided by the Promoter or Supplier commensurate to the level of risk associated with any activity in connection with the Promotion or Prize.

As a condition of accepting the Prize, each winner agrees that the Promoter will not be liable for any injury or damage, howsoever causes, associated with or in connection with the Prize and acknowledge that they undertake any activity at their own risk

  1. Waiver and Severance

Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

If any term or provision of these Terms is held by a court of competent jurisdiction to be contrary to law, then such provision shall be either severed or will be amended to best accomplish the objective of the provision. the remaining provisions of the Terms will be unaffected and remain in full force.

  1. Governing Law

All Entrants agree to submit to the exclusive jurisdiction of the courts of Western Australia.
